Terms of Service

Plain English summary: Use our services legally and respectfully. Pay for what you use. We own the platform; you own your content. We can suspend accounts that break these rules. We're based in Delaware, so Delaware law governs disputes.

These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "User") and SimbaApps LLC ("SimbaApps," "we," "our," or "us"), a Delaware limited liability company. By accessing or using any SimbaApps product or service — including our website at www.simbaapps.com and all associated applications — you agree to these Terms. If you do not agree, do not use our services.


1. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use our services. By using our services, you represent that you meet this age requirement and that you have the legal capacity to enter into this agreement. If you are using the services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Terms

2.1 Account Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@simbaapps.com if you suspect unauthorized access to your account.

2.2 One Person, One Account

You may not create multiple accounts to circumvent service limits, bans, or payment requirements. One email address per account.

2.3 Account Security

You are responsible for all activity under your account. SimbaApps is not liable for losses caused by unauthorized account access resulting from your failure to secure your credentials.

3. Free and Paid Services

3.1 Free Tier

We offer free access to a subset of features in our products. The free tier is provided "as is" without any SLA or uptime guarantee. We reserve the right to modify, limit, or discontinue any free tier features at any time with reasonable notice.

3.2 Premium Features

Certain features require a paid subscription ("Premium"). Premium pricing, features, and billing cycles are described on the applicable product's pricing page. By subscribing to Premium, you authorize SimbaApps to charge your payment method on the specified billing cycle.

3.3 Billing and Payments

Payments are processed by Stripe. Subscriptions renew automatically at the end of each billing period unless you cancel. All fees are listed in US dollars and are exclusive of applicable taxes. You are responsible for all taxes associated with your purchase.

3.4 Refunds

We offer a 7-day money-back guarantee for new Premium subscriptions if you're not satisfied. After 7 days, payments are non-refundable except where required by law. To request a refund within the 7-day window, contact support@simbaapps.com.

3.5 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain Premium access until the period ends. We do not prorate partial-period cancellations.

4. Acceptable Use

You agree not to use our services to:

  • Violate any applicable law, regulation, or third-party rights
  • Distribute spam, malware, or any harmful code
  • Harass, threaten, or harm other users
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Scrape, crawl, or extract data from our services without written permission
  • Use our services to train machine learning models without explicit written consent
  • Interfere with or disrupt the integrity or performance of the services
  • Resell, sublicense, or otherwise commercialize our services without authorization
  • Upload, store, or transmit content that is illegal, defamatory, obscene, or infringes on intellectual property rights

We reserve the right to investigate violations and take appropriate action, including account suspension or termination and referral to law enforcement where warranted.

5. Intellectual Property

5.1 Our IP

SimbaApps LLC owns all rights, title, and interest in our services, including all software, designs, logos, trademarks, trade names, and content we create. Nothing in these Terms grants you a right to use our trademarks or brand assets without prior written permission.

5.2 Your Content

You retain ownership of any content you create, upload, or store through our services ("User Content"). By submitting User Content, you grant SimbaApps a limited, non-exclusive, royalty-free license to host, store, and display your content solely for the purpose of providing the services to you.

5.3 Feedback

If you provide feedback, suggestions, or ideas about our services, you grant us the right to use that feedback without restriction or compensation. We appreciate your input!

6. Privacy

Your use of our services is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the data practices described in our Privacy Policy.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled or emergency maintenance, which could temporarily affect availability. We will make reasonable efforts to notify users in advance of scheduled downtime. SimbaApps is not liable for losses resulting from service unavailability.

8. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY CONTENT AVAILABLE THROUGH OUR SERVICES.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SIMBAAPPS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE OUR SERVICES.

IN ANY CASE, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER OR RELATED TO THESE TERMS OR OUR SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO SIMBAAPPS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless SimbaApps LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

11. Termination

11.1 By You

You may delete your account at any time from your account settings. Upon deletion, we will remove your personal data in accordance with our Privacy Policy.

11.2 By Us

We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for:

  • Violation of these Terms or our policies
  • Suspected fraud, abuse, or illegal activity
  • Non-payment of fees owed
  • Extended inactivity (free tier accounts inactive for 24+ months)
  • Any other reason we deem necessary to protect our services or users

If we terminate your account without cause, we will refund any prepaid fees for the unused portion of your current billing period.

11.3 Effect of Termination

Upon termination, your right to use our services ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including Sections 5, 8, 9, 10, and 13.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date, emailing account holders, or posting a notice on our website at least 14 days before the changes take effect. Your continued use of our services after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using our services and delete your account.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions.

13.2 Informal Resolution

Before filing any legal claim, you agree to first contact us at support@simbaapps.com and give us 30 days to attempt to resolve the dispute informally.

13.3 Binding Arbitration

If a dispute cannot be resolved informally, you and SimbaApps agree to resolve it through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration will be conducted in Delaware or by video conference. Each party bears its own costs.

13.4 Class Action Waiver

YOU AND SIMBAAPPS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

14. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy and any product-specific terms, constitute the entire agreement between you and SimbaApps.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
  • No Waiver: Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights in connection with a merger, acquisition, or sale of substantially all assets.
  • Force Majeure: We are not liable for delays or failures caused by events outside our reasonable control, including natural disasters, internet disruptions, or government actions.
